If an unqualified person is appointed as Member of Rajyasabha, what courts can do?

Usually, a writ petition for writ of Quo Warranto lies in High Court or Supreme Court, if it comes to knowledge of any person that certain unqualified person is occupying a government position which he not entitled to do,

As I understand, any person can file such petition. If there is sound basis for entertaining such petition, the Court may entertain such petition. It may reject such writ petition if it finds that there is no merit in it.
